Terms of Service

Template: replace every [bracketed] item and have a lawyer review before launch. Last updated [date].

These terms are an agreement between you and [Company name, LLC] ("we") for Rembrandt: the photo editor app, website and online services (the "Service").

Your account

The apps work without an account. You need one only for Cloud sync, which you turn on in Settings. Keep your sign-in email secure; you are responsible for activity on your account. You must be at least 16 years old (or the age of digital consent where you live).

Your photos

You own your photos and edits. You give us permission to store, process and transmit them only to provide the Service to you (for example to sync them between your devices, back up originals, or show photos to people you share a link with). AI features run on your device; we do not use your photos to train models.

Plans and payment

The desktop apps (Mac, Windows, Linux) and self-hosted copies of the web app are free. The web editor on our website is included with Cloud sync. The iPhone, iPad and Android apps are free to download; unlimited saving is a one-time in-app purchase in the App Store or Google Play, and those stores handle payment and refunds under their own terms. Cloud sync plans (128 GB, 192 GB, 256 GB, 512 GB and 1 TB of storage) are billed monthly or yearly in advance through our reseller and merchant of record, Paddle.com, which handles payment, tax and invoices, or through the App Store or Google Play if you subscribe there. Plans renew automatically until cancelled. You can cancel at any time (Settings → Cloud sync → Manage billing, or your store's subscription settings); access continues to the end of the paid period. Refunds follow the seller's buyer terms and applicable law.

Redeem codes

A redeem code (for example a Kickstarter reward or a gift) adds the stated Cloud plan to your account for the stated time. Each code works once, can't be exchanged for money, and may not be resold.

Storage limits and fair use

Each plan includes the storage shown on the plan. If you go over, you can't upload more originals until you free space or upgrade.

What you may not store or share

You may not use the Service to store, share or link to:

We report apparent child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC), as US law requires, and we cooperate with law enforcement. Every photo uploaded to Cloud (synced photos, stored originals and share links) is checked automatically against databases of known child sexual abuse images. A match is blocked, the account is suspended and the match is reported to NCMEC automatically. When we receive a report, we may take a link offline at once, keep the reported files and suspend or close the account. While a report is under review, the account can't upload, share or delete files.

Before a photo syncs, the Rembrandt app checks it on your device for sexually explicit content. Photos it flags stay on your device and aren't synced unless you choose to sync them anyway; that choice doesn't change anything above, and every synced photo is still checked and reported as described. The on-device check can be wrong in either direction, and it is not a guarantee that a photo is legal: you're responsible for what you sync.

Share links

Anyone with a share link can view the shared photos until the link expires or you stop sharing. Only share links with people you trust. Share links may not include sexually explicit images, even legal ones of consenting adults: photos are checked automatically before a link is created, a link with a flagged photo isn't created, and we remove links reported for explicit content once we've reviewed them. Anyone who sees a share link can report it from the link's page, or by emailing abuse@rembrandteditor.dev. We remove intimate images shared without consent within 48 hours of a valid request.

If you stop paying or delete your account

If a paid plan ends, your synced data stays readable so you can download it for at least [90] days. Deleting your account permanently deletes your online data, including originals stored online and share links. Photos on your devices are not affected.

Availability and changes

We work to keep the Service available but can't guarantee it will be uninterrupted. We may change or discontinue features; we'll give reasonable notice of material changes to paid features.

Liability

To the extent permitted by law, the Service is provided "as is", and our total liability is limited to the amount you paid us in the 12 months before the claim. Keep your own backups of important photos.
